Regulation 7 says night workers must be offered one. We run it on site, and the employer never sees an individual result.
Employers must offer night workers a free health assessment under regulation 7 of the Working Time Regulations 1998. Elixir Health runs those assessments on site, at the shift change, in about twenty minutes per worker. The employer receives aggregate figures only, with a suppression floor — individual results go to the worker and to no one else.
How it runs
- A small room, a table, two chairs. For finger-prick panels that is the whole spec.
- Booked by the worker on a tablet at the venue — never on paper, never through the employer.
- Each worker gets their printed result, explained, and their own record. The employer gets a count and nothing else.
- Employers' liability and public liability certificates, risk assessment and method statement, PAT certificates and the waste contract supplied fourteen days before the first day.
Why the employer never sees a result
Because the law on worker consent is clear that it is unreliable where there is a power imbalance, and because a health result belongs to the person it was taken from. Aggregate reporting with a suppression floor gives an employer what the regulation asks of them without giving them what it does not.
